Terms and Conditions 

1.Scope  

For all business relationships between violeva.com and the purchaser, only our 
General Terms and Conditions in their current version at the time of ordering apply.
In these Terms of Service, any reference to violeva.com shall be understood as a reference to the legal entity eComRevo. Additionally, the terms ‘us’, ‘we’, and ‘our’ refer to violeva.com.  All rights, obligations, and responsibilities outlined in this document apply to eComRevo as the official operator of this online shop. 

2. Conclusion of Contract

Our offers are non-binding and represent an invitation to order goods in our online shop. By clicking the "Order with obligation to pay" button, you submit a binding offer to purchase within the meaning of § 145 BGB. Upon receipt of the purchase offer, you will receive an automatically generated email confirming that we have received your order (order confirmation). This receipt confirmation does not yet constitute acceptance of your purchase offer. A contract is only concluded when we expressly accept the purchase offer (shipping confirmation) or when we send the goods to you without prior express acceptance.

3. Delivery and Shipping Costs

Information about the delivery time is non-binding and up to date in the shipping conditions.
Shipping costs for products without age verification range from $4.99 to $9.99. For items with age verification, it is  $6.99 to $14.99. Delivery within 2-12 working days - with tracking. 

4. Right of Withdrawal & Return

If you are a consumer within the meaning of § 13 BGB and are purchasing from a country within the European Union (EU) or the European Economic Area (EEA), you have a right of withdrawal in accordance with the following provisions:

Withdrawal Period 

You have the right to withdraw from this contract within 14 days without giving any reason.

Commencement of the Withdrawal Period

The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

Notification of Withdrawal 

To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post, fax, or email). You may use the provided contact information(support@violeva.com) for means of contact.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), to you as soon as possible. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back.

Return of Goods 

You shall send back the goods or hand them over to us without undue delay from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

Costs of Return

You will bear the direct cost of returning the goods. This cost may vary depending on the shipping method you choose for the return and may not be the same as the initial shipping cost paid to receive the goods. If the initial shipping was free, the actual cost of the return shipping will still be deducted from your refund.

Diminished Value of Returned Goods

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods. We may deduct an amount from the reimbursement for such diminished value.

Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to the following types of contracts:   
• Contracts for the supply of goods made to the consumer’s specifications or clearly personalized.   
• Contracts for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.
• Contracts for the supply of goods which are liable to deteriorate or expire rapidly.
• Contracts for the supply of goods which are, after delivery, according to their nature, inseparably mixed with other items.
• Contracts for the supply of alcoholic beverages, the price of which has been agreed upon at the time of the conclusion of the sales contract, the delivery of which can only take place after 30 days and the actual value of which is dependent on fluctuations in the market which cannot be controlled by the trader.
• Contracts where the consumer has specifically requested a visit from the trader for the purpose of carrying out urgent repairs or maintenance. If, during such a visit, the trader provides services in addition to those specifically requested by the consumer or goods other than replacement parts necessarily used in carrying out the maintenance or repairs, the right of withdrawal should apply to those additional services or goods.
• Contracts for the supply of sealed audio or sealed video recordings or sealed computer software which were unsealed after delivery.
• Contracts for the supply of a newspaper, periodical, or magazine with the exception of subscription contracts for the supply of such publications.
•  Contracts concluded at a public auction. 
The above right of withdrawal and exceptions apply only to consumers located in the European Union (EU) and the European Economic Area (EEA). For consumers in Switzerland, Canada, the USA, the UK, Ireland, Australia, and New Zealand, return policies are determined by our company's internal policies and may differ from the above-stated provisions.

5. Payment Terms

Payment for the goods is made either by advance payment or PayPal. violeva.com reserves the right to exclude certain payment methods in individual cases. Invoicing is done without exception, including the applicable value-added tax. Payment by sending cash or checks is unfortunately not possible. We exclude liability in case of loss. Payment by advance payment: Prepayment. Shipping takes place after receipt of payment.

6. Retention of Title

Until full payment, the goods remain the property of violeva.com. If you are an 
entrepreneur within the meaning of § 14 BGB, additional provisions may apply.

7. Warranty and Liability

If delivered items have obvious material or manufacturing defects, including transport damage, please report such defects immediately to violeva.com. For these and all other defects of the purchased item occurring during the statutory warranty period, the purchaser's statutory rights apply in accordance with § 437 BGB.

8. Delivery Reservation

The sale of the offered goods is only to persons of legal age. Violeva.com reserves the right to reject incoming orders for economic reasons, even without justification. We reserve the right not to provide the promised service in case of unavailability. At the same time, we undertake to inform you immediately about the unavailability and to refund any consideration received immediately. Errors and changes are expressly reserved. 

9. Data Protection

The personal data necessary for processing the contract is provided by the purchaser. The personal data necessary for the execution of the transaction is stored and, if necessary, passed on to third parties within the framework of the proper handling of the order processing. The handling of the data is in accordance with the provisions of the Federal Data Protection Act and the Telemedia Data Protection Act. All personal data is treated confidentially. We have particularly high security standards and undertake to protect your data from any unauthorized access.

10. Alternative Dispute Resolution

In accordance with EU Regulation No. 524/2013, the European Commission provides a platform for online dispute resolution (ODR) to facilitate independent, out-of-court settlements of disputes between consumers and online merchants. The ODR platform is accessible at: https://ec.europa.eu/consumers/odr/.
Please note that while we provide information about the ODR platform to comply with EU regulations, we prefer to handle disputes directly through our internal customer service channels. We are not obligated to and do not participate in out-of-court dispute resolution proceedings before a consumer arbitration body.

11. Final Provisions (Severability Clause)

If one or more provisions of these terms and conditions are or become invalid, this shall not affect the validity of the remaining provisions. German law applies exclusively to contracts between us and you, excluding the provisions of the United Nations Convention on Contracts for the International Sale of Goods (CISG, "UN Sales Law"). Mandatory provisions of the country in which you usually reside remain unaffected by the choice of law. If you are a merchant, a legal entity under public law, or a special fund under public law, our place of business is the place of 
jurisdiction for all disputes arising from or in connection with contracts between us and you.

12. Copyright

Copyright by violeva.com. The pages of our online shop are protected by copyright. Imitation, even in part, is only permitted with the permission of violeva.com. The illustrations are protected by § 72 of the Copyright Act.

13. Information for "Not Picked Up" or "Not Delivered"

We will make every reasonable effort to deliver your order. However, the customer is responsible for ensuring accurate delivery details and accepting the package when delivery is attempted.

If an order is returned as unclaimed, undeliverable, or refused for reasons including, but not limited to:

• Incorrect or incomplete address

• No name on the doorbell/mailbox

• The recipient moved

• The recipient did not collect from a designated pickup location within the timeframe specified by the courier

• The recipient refused delivery for reasons unrelated to product defects

The following conditions apply:

1. Order Considered Fulfilled – No Automatic Refund

Once an order has been shipped to the address provided at checkout, it is considered successfully processed and fulfilled. If a package is returned as undeliverable or unclaimed, no automatic refund is issued, and the customer remains responsible for all costs.

2. Reshipment (If the Package is Returned to Us)

If an undeliverable package is returned, you may request re-shipment. In this case:

• The customer must pay for all re-shipping costs, including any return handling fees charged by the courier.

• We reserve the right to charge an administrative fee for processing the return and re-shipment.

• If the package is lost, abandoned, or otherwise disposed of by the courier due to non-collection, we bear no liability, and no refund will be issued.

3. Refund Request (Only If the Package is Returned to Us and in Resellable Condition)

If you choose to cancel the order instead of reshipping, we may offer a partial refund under the following conditions:

• USA & Canada: The refund excludes all shipping fees, return courier fees, and an administrative processing charge of up to 20% of the product price.

• UK & Ireland: Refunds will be processed at our discretion, with deductions for original shipping, return costs, and a possible handling fee, except where consumer laws prevent such deductions.

Australia & New Zealand: Refunds will exclude all shipping-related costs and may be subject to a restocking fee, where legally permissible.

Packages That Are Not Returned to Us: If the courier destroys, abandons, or otherwise refuses to return an unclaimed package, no refund will be issued under any circumstances.

Additional Customer Responsibilities

• If the customer enters an incorrect address, and the package is delivered to that address, the order is considered fulfilled, and no refund or replacement will be issued.

• If the package is marked as delivered by the courier but is not received by the customer, it is the customer’s responsibility to dispute this with the courier. We are not responsible for stolen, misplaced, or misdelivered parcels.

• If the package is refused for any reason other than a proven product defect or seller error, the order will be considered completed, and the customer remains responsible for all related costs.
